TERMS & CONDITIONS
These terms are from Mr Peter Bresser, trading as Bresser Photography & Digital Media (The photographer)
The Photographer has creative and artistic licence in relation to the choice of locations and poses or angles used and his judgement on photographic style and the number of photographs taken shall be deemed correct.
Images from the session(s) will be digital and in jpeg format but not original RAW or DNG files. Images will be supplied ready to use, following lighting and exposure adjustments to any image as deemed necessary by the photographer. Further editing of images may be required following the session and will be charged according to the photographer’s rates. Some materials may reproduce differently printed, compared to the human eye. All efforts will be made to ensure colour accuracy, and therefore colour matching will be deemed correct at The Photographer’s discretion.
All images are provided “as is”. The photographer offers no warranty, explicit or implied, regarding any images under this agreement including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. The photographer does not represent or warrant that the images will meet your requirements or that their use will be error free.
The photographer retains copyright of all images and derivative works, but grants a license to its clients its partners and agents for use of any or all images taken at commissioned sessions, provided the use of any or all images does not infringe the photographer’s moral rights as described in the UK’s Copyright, Designs and Patents Act 1988. Any images supplied from the photographic sessions may not be sold on to third parties, without prior consent from the photographer. Copyright transfer is possible for an agreed sum. POA.
Acceptance of a proposal or quote from The photographer is to accept the terms and conditions set out above.
Model Release
I do hereby consent and agree that The Photographer, Pete Bresser T/A Bresser Photography & Digital Media (Bresserphotos) its employees, or agents have the right to take photographs of me and my immediate family and friends on the date of the session and can use them in any and all media, now or hereafter, for the purpose of The Photographers’ own business advertising, promotion or in The Photographers’ work portfolio.
I do hereby release to The Photographer, its agents, and employees all rights to exhibit this work in print and electronic form publicly or privately.
I waive any rights, claims, or interest I may have to control the use of my identity or likeness in whatever media used.
I understand that there will be no financial or other remuneration for photographing me by the Photographer.
I also understand that The Photographer is not responsible for any expense or liability incurred as a result of my participation in this photography, including any issues incurred as a result.
I represent that I am at least 18 years of age, have read and understand the foregoing statement, and am competent to execute this agreement.
